Many people yearn to live an apartment lifestyle, where they can reside in the city and stay connected to work, shopping malls, and more without any hassles. It’s not just about the location, but the amenities the residents enjoy by residing in an apartment. One of the key perks that comes with living in an apartment is apartment car parking. Parking lots in the basement are a huge advantage for the residents as they don’t have to struggle to find a lot. These lots are usually named according to flat numbers, making parking easy and hassle-free. But that’s not the end, with everything comes rules, and car parking has its own set of rules and regulations.

Importance of Apartment Car Parking Rules


Car parking is a top concern for potential homebuyers, especially in high-rise buildings. Problems can arise without clear parking rules, leading to resident conflicts. Parking bylaws, governed by the management committee registered under the Societies Registration Act of 1860, are here to help with resident parking issues.

Residential Welfare Association

RWA, or Residential Welfare Association, is a non-profit organization that strives to enhance the well-being and interests of the residents. When the majority of flats or apartments are booked, housing societies must create an RWA within 90 days, as required by the RERA (Real Estate Regulatory Authority) Act.

RWAs are controlled by a Managing Committee that is established under the Societies Registration Act of 1860. It implies you should contact them if you have any concerns as a housing society resident, not only parking.

Let’s take a look at some key car parking rules in residential areas.

  1. The apartment complex/housing society owns any shared/common space in the community.
  2. RWA requires residents/vehicle owners to submit their RC book copy along with the application, and maintain a list of parked cars.
  3. Any resident who wishes to receive a stilt parking place must make a written request to the secretary of the organization.
  4. Because parking allocation falls under the competence of the housing society’s management committee, the MC (RWA) or General Body might give parking places to residents who have completed their registration.
  5. The parking spots in your neighbourhood are all numbered according to the LOP (Lay-Out Plan) approved by the local authority.
  6. We do not permit any member to park more than one car in the same parking place. Requests for a second slot can be made on an annual basis, subject to parking space availability
  7. Do not park in front of the main gate, elevator exit area, park, or any other location that may hinder public access for residents.
  8. While driving into the premises, maintain a speed limit of 10 km/hr.
  9. Parking for visitors is typically available outside the premises. Do not request an exemption from the security guards. Please inform the security officer if you plan to have any visitors stay overnight so that we can properly park their vehicles.
  10. The Managing Committee, or RWA, provides parking stickers to all Indian apartment tenants. If you have a sticker on your car, you do not need to go through a security check every time you enter or drive inside the society’s grounds.
  11. Make certain that you stay on the right path and park in the proper area. Many inhabitants in India’s residential zones breach parking regulations and pay penalties as a result.

Car Parking Laws in India

The RERA Act of 2016 governs apartment parking rules in India. Builders can offer covered garage space separately under this act. We cannot individually charge open parking and communal amenities like lobbies, staircases, and gardens. After registration, an Occupation Certificate from the municipal corporation, and the builder’s transfer, these areas become society property. The Ministry of Housing and Urban Affairs mandates two Equivalent Car Spaces (ECS) per 100 square meters of residential floor space. This allocates one parking spot for every 3 bhk apartment and two spaces for each 4 bhk apartment. The Development Control Regulations of each state require builders to provide parking space, though the provisions may differ.
